EU: Apple Store can be trademarked
The highest court in the European Union rules that the characteristic layout of the Apple Store can be registered as a trademark. This reverses a lower court’s ruling to reject the trademark:
The Court takes the view in this respect that a representation that, such as the one in the present case, depicts the layout of a retail store by means of an integral collection of lines, curves and shapes, may constitute a trade mark provided that it is capable of distinguishing the goods or services of one undertaking from those of other undertakings.
